Modern Slavery refers to any person/s holding another in slavery or servitude; and requiring the performance of forced and compulsory labour. Human trafficking is where a person/s facilitates the travel of another with the view of exploiting such individual for personal or commercial gain. Modern slavery and human trafficking are heinous crimes and morally reprehensible acts which deprives individuals of their liberty and dignity.

In terms of the Bill of Rights as contained in the Constitution of the Republic of South Africa, no one may be subjected to slavery, servitude or forced labour. The Bill of Rights applies to all law and binds the legislature. Accordingly modern slavery is a violation of basic human rights and constitutes a crime.
